Overview of GMoU

What is GMoU

  • A comprehensive agreement between Chevron Nigeria Limited (CNL) and the Regional Development Committee (RDC) (a group of communities) within a geographical area.
  • Signed by RDC (on behalf of communities), CNL & State Govt.
  • It specifies CNL’s activities, benefits to communities in terms of development and other basis for relationship over a period of time (3 years)
  • It is part of sustainable community development efforts of CNL
  • It specifies how CNL would relate with communities in their area of operation
  • Involves several stakeholders in its implementation
  • It has a governance structures with committees 

Objectives of GMoU

  • Participatory Partnership
    • To encourage CNL and RDC to work with the State Govt and other stakeholders (NGOs, NDDC, Development Organizations etc.)
    • To partner for the promotion of Development, Peace & Security
  • Transparency and Accountability
    • To encourage the parties to operate open & accountable system through the implementation of the governance model of the GMoU
  • Capacity Building
    • To transfer responsibility and accountability to the RDC with respect to planning and execution of development projects/programs
    • RDC to own and manage their own development programs
    • To help community members gain and develop relevant skills 
  • Safety, Security and Rule of Law
    • To jointly promote safe and secure environment within and around the communities
    • To help CNL fulfill its business goals
  • Community Empowerment and Sustainable Development
    • To assist the RDC in its efforts to peacefully lead the communities
    • To assist RDC in its quest for economic development
  • Improved relationship between CNL and RDC
    • To promote a harmonious relationship between the communities and CNL

Role of Stakeholders - RDC

  • Ensure peace, harmony and development in the communities
  • Advocate for good governance (from state & local govts)
  • Provide leadership & programme co-ordination
  • Identify community needs & problems
  • Ensure effective execution of development projects
  • Ensure transparency and accountability in the process
  • Ensure equitable distribution of benefits of the GMoU process to the stakeholders groups
  • Ensure adequate communication with the communities on GMoU activities

Role of Stakeholders - CNL

  • Provide resources for the implementation of GMoUs process
  • Participate in the GMoU committees
  • Provide technical supports for the implementation of GMoUs process
  • Support in terms of mobilizing resources and advocacy for the process
  • Provide coordination among stakeholders within the process

Role of Stakeholders – State Government

  • Ensure harmonization of RDC projects with overall development plans of the state.
  • Participate in peace and conflict resolution
  • Participate in the GMoU committees
  • Provide technical supports for the process
  • Ensure transparency and accountability
  • Provide linkages with development players
  • Serve as signatory to project accounts

Role of Stakeholders – Local Government

  • Provide technical support for the process
  • Provide linkages with development players
  • Contribute to peace and conflict resolution
  • Ensure peace, harmony and development in the communities
  • Ensure harmonization of RDC projects with overall development plans of the state and local govts
    Participate in the GMoU committees

Role of Stakeholders – NDDC

  • Provide technical supports for the process
  • Provide linkages with development players
  • Ensure peace, harmony and development in the communities
  • Ensure harmonization of RDC projects with overall development plans of the NDDC
  • Participate in the GMoU committees

Role of Stakeholders – NGO

  • Ensure input from professional development agencies
  • Bring on board best practices in the development sector
  • Provide technical supports & capacity building
    • Ensure transparency and accountability
    • Undertake advocacy for the process
    • Participate in process management and implementation
    • Provide linkages with development players

Governance Structure – Basics

GMOU-organogram

Community Engagement Management Board (CEMB)

  • Composition
    • RDC, NGO, NDDC, NAPIMS, Donor Agency, State Government
    • Local Government , CNL
  • Duties
    • Provide general oversight for its sub-committees and Community/ CNL relations
    • Engage and pay external auditors.
    • Review the reports of all sub-committees and take decision as appropriate
    • Review funding requests and approve cash withdrawals
    • Engage in conflict resolution between stakeholders
    • Review audited accounts
    • Work to enlarge the resource base of the RDC for the development of the communities

Projects & Programs Review Committee (PPRC)

  • Composition
    • RDC, CNL, NGO, NDDC, State Government, LGA, NAPIMS
  • Duties
    • Work with RDC to develop a CD plan
    • Ensure the CD plan is in alignment with the development plans of NDDC, State Government, Local Governments
    • Ensure that the CD plan meets community needs
    • Ensure transparency and accountability in the design and execution of all projects
    • Ensure projects are selected from the approved CD plan
    • Review budget proposals, contracting plans and validate project execution plans
    • Request funding for CD plan through the CEMB.
    • Monitor all projects and plan maintenance of same
    • Report and be responsible to the CEMB.

Peace Committee (PC)

  • Composition
    • RDC, CNL, NGO, NDDC, State Government, NAPIMS
  • Duties
    • Assist in resolving conflict as indicated in the conflict resolution process
    • Promote peace building in the communities

Accounts Audits Committee (AAC)

  • Composition
    • RDC, NGO, Donor Agency, State Govt, CNL
  • Duties
    • Regularly advise the RDC on the status of accounts and budget preparation
    • Act as “gatekeeper” to account and ensure that all documentation is complete and maintained.
    • Ensure transparency and accountability
    • Ensure the preparation of annual audited accounts.
    • Monitor and track fulfillment of parties’ commitments and adherence to CEMB’s decisions and report to CEMB.

Communication, Advocacy & Mobilisation Committee

  • Composition
    • RDC, CNL, NGO, State Government, Local Government
  • Duties
    • Ensure all communication is effectively done and as at when due
    • Monitor parties communication commitments
    • Provide regular report of its activities to CEMB
    • Perform other functions as the CEMB may assign to it
